What is probate?

The term "probate" is used to refer both to the 'Grant of Probate' and also the process of administrating someone's estate when they die.

What is a grant of probate?

Grant of probate is a document issued by the court which validates a will and gives the executors the authority to administer the estate.

How long does probate take?

There are three main stages of probate. The first stage is assessing the estate. The second stage includes working out what tax is due and applying for the Grant of Representation. The third stage is the administration of the estate.
The time these stages take will depend on the complexity and size of the estate and whether inheritance tax is due. If inheritance tax is not due, then the estimated time the application will take is 8-12 weeks.
